You must not abuse, harass or threaten Qwickly.com staff, editors or others who use Qwickly.com.

You cannot link to any worms or viruses or any code of a destructive nature.

You cannot attempt to automatically redirect Qwickly.com users to other domains, mislead users of the origins of the content contained in blog comments and message board posts, or use such content as storage for remote loading or to a website outside of Qwickly.com.

You cannot use the Qwickly.com to distribute, share or solicit content belonging to third parties without proper authorization from the owner of that content. You must respect the proprietary and intellectual property rights of others.

You cannot impersonate a Qwickly.com staff member, editor other Qwickly.com user.

You may not create content written primarily in a language other than English.

Discontinuation of Service

Qwickly.com reserves the right to modify or discontinue, temporarily or permanently, the service or any portion thereof, without liability to user or any third party. In addition, Qwickly.com, in its sole discretion, may terminate user password, account or use of or access to the service and remove and delete any content for any reason.

Indemnification

You agree to indemnify, defend and hold Qwickly.com and its partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information, attorneys, advertisers and affiliates harmless from any liability, loss, claim and expense, including reasonable attorney’s fees, related to violation of these Terms or use of Qwickly.com.

Limitation of Liability

You expressly understand and agree that Qwickly.com will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if advised of the possibility of such damages), resulting from the use or the inability to use the website, unauthorized access to or alteration of logs, content transmissions or data, statements or conduct of any third party on the Service, or any other matter relating to the service. Qwickly.com also will not be liable for any loss or damage arising from your failure to comply with the provisions of these Terms.

Governing Law

These Terms will be governed by the laws of the State of Texas without regard to its conflict of law provisions.

Entire Agreement

These Terms, together with the Qwickly.com Privacy Policy and any other agreements incorporated by reference in these Terms or entered into between you and Qwickly.com, constitute the entire agreement between you and Qwickly.com and govern your use of the service, superseding any prior agreements between you and Qwickly.com.

Waiver

The failure of Qwickly.com to exercise or enforce any right or provision of the Terms will not constitute a waiver of such right or provision.

Acceptance

By utilizing the Qwickly.com website, you automatically accept these terms. By thus accepting these terms, you waive your right to go to court, to have a jury trial, to participate in a class action lawsuit or any other legal action against Qwickly.com.
